Good to know before buying farm land in the Philippines

Land deals here have rules of their own. These are general pointers, not legal advice: always check with the government office concerned and a lawyer before you pay anything.

Check the title first

Ask for a certified true copy of the title from the Registry of Deeds (Land Registration Authority) and make sure the owner, area and technical description match the tax declaration and the land on the ground.

Agrarian reform land has limits

Land awarded under agrarian reform (CLOA or Emancipation Patent) can have limits on sale and transfer. Ask the Department of Agrarian Reform (DAR) office for the area before you agree to anything.

Who can own land

Under the 1987 Constitution, private land can generally be owned only by Filipino citizens and by corporations that are at least 60% Filipino-owned. Others may lease land; ask a lawyer about the options.

Licensed brokers

People who sell property for others for a fee must be licensed by the Professional Regulation Commission (PRC) under the Real Estate Service Act (RA 9646). You can check a broker’s license on the PRC website.

Changing land use

Turning farm land into housing or other non-farm uses needs DAR conversion approval, and some irrigated and prime rice land is protected. Do not buy farm land on a promise that it can be converted.
